Terms of Service

1. Who we are

DarkCoder.ai ("we", "us") operates the gateway and cockpit available at https://darkcoder.ai (the "Service"). The Service lets you route requests from your own tools to AI providers you connect, using one OpenAI-compatible endpoint, gateway keys and fallback combos. You can reach us at hello@ajens.org.

By creating an account, signing in, or using the Service you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.

2. Your account

  • You must provide accurate information and keep your credentials confidential.
  • You are responsible for everything done through your account and your gateway keys. Revoke a key immediately if you think it has leaked.
  • You must be old enough to form a binding contract where you live, and at least 16 years old.
  • If you use the Service for an organisation, you confirm you may bind that organisation.

3. Third-party providers and your connections

The Service connects to AI providers such as GitHub Copilot, Anthropic, Google, OpenAI, xAI, DeepSeek, Groq, Cognition (Devin) and local models. You decide which providers to connect and which models to call.

  • Your prompts, files and other content are sent to the provider that serves a request, and are governed by that provider's terms and privacy policy, not by ours.
  • You are responsible for holding the right to use each provider account, token or API key you connect, and for complying with each provider's terms, including limits on automated or third-party access.
  • Provider tokens you connect are stored encrypted. You can disconnect a provider at any time, which stops the Service from using it.

4. Acceptable use

You must follow the Acceptable Use Policy. We may rate-limit, suspend or remove access that breaks it or puts the Service or others at risk.

5. Availability and changes

The Service is provided on an as-is, as-available basis (see the Disclaimer). We may change, suspend or discontinue features, and we may update these Terms. When we make material changes we will update the version and date shown on this page; continuing to use the Service after a change means you accept it.

6. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your use creates risk or cost for the Service. Sections that by their nature should survive termination (including limitation of liability) will survive.

7. Intellectual property

You keep ownership of your content. You grant us only the limited permission needed to operate the Service for you, such as relaying requests to the providers you choose and keeping logs you can see. The Service, its software and branding remain ours or our licensors'.

8. Limitation of liability

To the fullest extent permitted by law, DarkCoder.ai is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service or of any third-party provider. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and 100 USD. Nothing in these Terms limits liability that cannot be limited by law.

9. Indemnity

You agree to indemnify DarkCoder.ai against claims arising from your content, your breach of these Terms, or your breach of a provider's terms through the Service, to the extent permitted by law.

10. Governing law

These Terms are governed by the laws of [Jurisdiction], and the courts of [Jurisdiction] have exclusive jurisdiction, except where mandatory consumer law gives you other rights.
